I totally agree on EB3 to EB2 porting but the PD should be the day he qualified as EB2 not the original date of EB3 which makes sense.
This way everyone is happy.
People who have done Masters (EB2) should get the GCs first. :) ...Relax dont give me a red for this. I already had enough.

i have been a active member for quite some time but i wasnt aware of the financial sacrifices IV Core team was making until I read the businessweek article. i have been contributing monthly recurring payments and one time contributions as and when necessary.
Thanks to whoever started this topic to refund some of the expenses core team has met. Thanks to IV core team for their unselfish acts and sacrifices.
i shall see if i can contribute more in the near future to this fund.

My employer is also behaving exactly similar way... Spend the money from your own Pocket ( 350 med + 385 ) around $750 and ask them to just
give the Future Employment Verification Letter for 485.
I'm finishing up all forms and other activities Like Medical , Birth Certificate etc..
After that pounce on your employer for Letter + the fees for 485 + fees for your own attorney fees ... If they disagrees come to a deal with just for the Letter... You are all set then !!
If they still dont agree i'll tell them that you are resigning and immigrating to Canada (Tell them that your Canadian PR is almost approved and you have a distant relative there)

I guess it would have to be a pretty big and wild rally to have the police getting involved. :p
But Chandu raises an excellent point. There is much more to a rally than just turning up. Some one from core can probably help with detailed instructions.. these are just my thoughts.. feel free to add/correct.. (PS: I have zero experience in rallies, by the way)
First, I suppose checking with the local authorities and informing them of your plans, expected turnout, location, duration etc before anything else is a good idea. Bad idea to have have an unexpected crowd turn up randomly in a public place.
Organize placards, banners, podium, hand outs etc. Dont forget first aid kits, water.
Figure out who is going to be the spokesperson for the rally. Would be pretty silly if a reporter does come there and no one knows how to articulate well.
The spokesperson should check with core regarding message etc. This is important.
If there is critical mass for the rally, and the authorities are informed etc, then contact the local news and inform them as well..

You might be right. Check the response senator got from USCIS on Aug 6th. I was later approved on Aug 16th.

In reviewing the electronic records, it does appear that the contractor has placed these cases in a location where they will be pulled and sent to an officer. We are unable to request the files be moved to an Adjudications Officer because our Records Division is running an electronic sweep to pull the files with available visas. No employer can advertise a job only for GC/Citizen unless they have a valid reason (the job needs security clearance etc.).
What are you drinking? How can GC holder get security clearance? Also, there are some jobs that may require US citizen without any requirement for security clearance. Example: Defence projects.
BTW the law does not say that authorized alien should have a work permit allowing him to work for any employer.
Read I-9 form. Employee must have work authorization before he/she can start work.

The 485 application ( See on page 4 1st para ) clearly states that they need a letter from employer stating that the job for which GC has been filed is still available and the salary will be paid as per the LC and 140. This is NOT current employment verification letter. Period. Its about future job. The job titles of H1B (current job) and GC (future job) can be different. Get out of the H1B transfer and extension mode.
If the letter from employer is part of initial evidence and you don't have it, your application might come back as per the memo release on Jun 16th.

Please read my signature section below for the progression of my applications. I am relieved that USCIS actually has my applications and can rest assured that those documents will sit on someone's desk or shelf for God knows how long ;)
It took more or less 30 days to process my filing, and hopefully you will see that happening as well.
Supoort collective cause and the DC rally. I can't attend, but am contributing $ for someone else to fly to Washington, DC.

My date is not current but I understand the frustration here. However I beleive USCIS is under severe pressure to reduce the backlogs and not waste any numbers this year....so they are trying to exhaust them as and when they can...in that scenaio I guess lower hanging fruits are getting picked.
But on the bright side as I see it as more and more people get their GCs its a smaller line and the officers should be able to get to everyone's file in due course.
I completely believe the system should be FIFO but then don't you think that will be too logical for the USCIS......
Hopefully if they are able to get a lot of people out of the way they should go back to normal processing from October when new numbers are available and the pressure is somewhat less.....
Again above is my theory. I hope everyone gets their green cards soon and the line keeps moving.
